Help - Bookseller Terms & Conditions

Bookshops.com.au reserves the right to make changes to these terms and conditions. If Bookshops.com.au makes changes, Bookshops.com.au will inform The Bookseller of the changes by sending an e-mail to The Bookseller at least 15 days before the changes are effective.

Who can sell on Bookshops.com.au
Only Australian Booksellers with a valid Australian Business Number (A.B.N.) are permitted to sell books on the Bookshops.com.au web site.

Payments to Bookshops.com.au
The Bookseller agrees to give Bookshops.com.au the right to deduct funds from The Bookseller's nominated credit card on a monthly basis for commissions from sales of The Bookseller's books through Bookshops.com.au web site. Commissions are charge by Bookshops.com.au at the rate of:
10% +GST of The Bookseller's first $500.00 of total sales each month.
5%+GST of The Bookseller's total sales between $500.00 and $1000.00 each month.
2%+GST of The Bookseller's total sales over $1000.00 each month.

Selling on Bookshops.com.au
Information describing books or other items added to Bookshops.com.au web site by The Bookseller must provide a correct and propper description, including the condition of the book or item. Any book or other item received by The Customer not as described may be returned to The Bookseller and a full refund given to The Customer.
Books or other items added to Bookshops.com.au must contain specific descriptions of any defects such as mould, damaged bindings or underlining etc.
The Bookseller must have the legal right to offer and sell any books or other items added to Bookshops.com.au web site by The Bookseller.
The Bookseller must not add books or any other items to Bookshops.com.au which are prohibited for sale under Australian law, be counterfeit, fraudulent, stolen, contain pornography, be obscene, be unlawfully threatening or harassing, defamatory or trade libelous, infringe any third party's copyright or other proprietary rights.
The Bookseller must not add or upload any computer code that contains computer viruses, or any other computer programming scripts.

Privacy of Customer Information
Any information The Bookseller receives from The Customer or any other users of Bookshops.com.au web site must be treated by The Bookseller as strictly confidential. The Bookseller must not share or disclose this information to any 3rd party. This information may only be used by The Bookseller to process orders or enquiries. When storing this information Bookseller must ensure this information is stored securely.

Transactions on Bookshops.com.au
All transactions on Bookshops.com.au are between The Bookseller and The Customer. Bookshops.com.au do not take title to books or any other items The Bookseller lists on Bookshops.com.au. Bookshops.com.au are not a party in any transactions between The Customer and The Bookseller.

Bookshops.com.au will not be held responsible for any and all claims, liabilities, obligations and expenses arising from, connected with or relating to dealings between The Bookseller and The Customer Bookshops.com.au will not be held responsible for any breach of this Agreement by The Bookseller.

Disclaimers
The Bookseller's use of the Bookshops.com.au web site is at The Bookseller's own risk. Bookshops.com.au will not under any circumstances be liable for any losses, damages, costs and other consequences resulting directly or indirectly from using this site and any information or material available from it.

Bookshops.com.au excludes all liability to any person, arising directly or indirectly from using this site and any information or material available from it.

Bookshops.com.au will make all reasonable efforts to make its web site server and content available on a 24-hour basis, excluding normal network administration and system down-time, but if access is suspended or interrupted, liability shall be limited to restoring access to the server as soon as reasonably practicable. The Bookseller agrees to indemnify Bookshops.com.au from and against all actions, claims, suits, demands, liabilities, costs and expenses arising out of or in any way connected with use of this web site by The Bookseller or any other person using The Bookseller's username and password.

Termination of this Agreement
Either Bookshops.com.au or The Bookseller may terminate this Agreement at any time effective immediately upon written notice of termination to the other. Bookshops.com.au may, without any notice, suspend or terminate The Bookseller's permission to use the Bookshops.com.au web site and accept no liability to The Bookseller or any other person. Upon termination of this Agreement the Bookseller will be liable for any unpaid commissions owing from sales through Bookshops.com.au. Bookshops.com.au Intellectual Property Bookshops.com.au web site content may not be copied and is protected by Australian and international copyright, trade-mark, and other laws. Accepting this agreement does not transfer to The Bookseller any ownership or any other rights to the Bookshops.com.au web site and its contents.

Security
The Bookseller must not send or disclose their username or password to anybody other than Bookshops.com.au.
The Bookseller accepts responsibility for all aspects of use of this web site by all persons using The Bookseller's username and password.
The Bookseller's and The Customer's sensitive data is captured and passed through a server using encryption technology and stored customer information is protected through the use of encryption, secure passwords and user log ons to minimise the risk of unauthorised access. However, the Internet is not a secure environment and Bookshops.com.au cannot guarantee that communication between Bookshops.com.au and The Bookseller or Bookshops.com.au and The Customer over the Internet will be secure. The Bookseller's use of the Bookshops.com.au web site is The Bookseller's responsibility and entirely at The Bookseller's own risk.

Legal Matters
The Bookseller must comply with all Australian laws and regulations.
This Agreement and the rights of the parties is governed, construed and enforced in accordance with the laws of New South Wales, Australia without recourse to any choice of law or venue laws. All disputes against Bookshops.com.au arising out of or related to this Agreement or Bookshops.com.au web site must be brought in New South Wales, Australia
